Hillary C. Agnost
Hillary C. Agnost has been representing and providing coverage advice to major domestic insurance companies for over seven years. Her practice emphasizes analysis of complex third-party liability coverage issues presented under a wide variety of insurance policies on the primary and excess/umbrella levels: Errors and Omissions (professional liability, employee benefits, and employment practices), General Liability, and Personal Lines (auto, homeowners, and personal umbrella). She is experienced in evaluating coverage under both standard ISO and manuscript insurance contracts.
Ms. Agnost counsels clients with respect to a variety of issues under the law of multiple states, including professional malpractice, construction defects, contractual indemnity and additional-insured liability, intellectual property, pollution, and habitability claims.
Ms. Agnost has handled and assisted in trial preparation for complex, multi-jurisdictional coverage litigation and contribution litigation in state and federal court, and she routinely resolves claims for clients through dispositive motions and on appeal. Ms. Agnost represented and prepared the appeal for the prevailing party in Prince v. United National Ins. Co. (2006) 142 Cal.App.4th 233, the first published California case to address whether “auto use” exclusions bar coverage for injuries to children left in overheated automobiles. She frequently participates in mediations and other ADR processes, and she successfully achieves efficient resolutions of complicated coverage matters for her clients.
